Texas Trucker Disciplined For Regulatory Violations

On behalf of Lovett Law Firm posted in Truck Accidents on Monday, October 28, 2013.

Three licensed truck drivers were recently declared as imminent hazards by the Federal Motor Carrier Safety Administration following investigations that revealed they were not abiding by federal safety regulations. One of the drivers is a Texas man who struck two pedestrians changing a flat tire on the side of a road near Harrison, Arkansas. Both of the pedestrians were killed in the incident.

A subsequent investigation by the Federal Motor Carrier Safety Administration revealed that the Texas trucker did not disclose to three different employers in the preceding nine months that he had been involved in five commercial motor vehicle accidents and had been terminated multiple times for high risk driving.

The investigation also determined that he had medical conditions which potential disqualified him from working as a truck driver, but which he either did not disclose to multiple employers.

It is not uncommon for the Federal Motor Carrier Safety Administration to take action against commercial drivers for violations of federal safety regulations. Since the beginning of 2013, the agency has declared 10 commercial driver’s license holders to be imminent hazards and blocked them from working in interstate commerce.

When truck drivers fail to abide by safety rules, they not only put themselves at risk, they put other drivers at risk. When a big rig driver gets into an accident with another vehicle, it is the other driver that will bear the burden of suffering. Victims of such accidents have the right to seek out appropriate compensation. Those who have been involved in a truck accident do well to contact an experienced personal injury attorney.
